Welcome to Investor First LLC, doing business as Investor First Lending (“Investor First Lending,” “Investor First,” “we,” “us,” or “our”). We provide the website at www.investorfirstlending.com, including any subdomain (the “Site”), and, together with our services, tools, and networks (including any new features and applications), the “Service.”
By accessing or using the Service, you signify that you have read, understand, and agree to be bound by these Terms of Use (as updated from time to time, the “Terms of Use” or “Terms”), whether or not you create an account or apply for products or services. “You” includes you and any of your agents (e.g., a mortgage broker acting on your behalf) and any principal or entity (e.g., an LLC or corporation) on whose behalf you access the Site. If you access or apply on behalf of an entity, you represent that you have authority to bind that entity, and your use constitutes that entity’s agreement to these Terms.
In addition to these Terms, certain parts of the Service may be subject to additional terms posted on the Service from time to time (e.g., our Privacy Policy and E-Sign Consent). All such terms are incorporated by reference into these Terms.
Changes to Terms of Use
We may modify these Terms at any time by posting the updated Terms on the Site. Your continued use of the Service following any changes constitutes your acceptance of the revised Terms.
If you enter into a separate written agreement with us regarding specific aspects of the Service, that agreement will control to the extent of any conflict with these Terms for the subject matter covered by that agreement.
Eligibility
The Service is intended solely for users who are 18 years of age or older. By using the Service, you represent and warrant that you are 18 or older and agree to abide by these Terms. We may, in our sole discretion and at any time, suspend or terminate your account or access to the Service (with or without notice) for any reason, including if we believe you are under 18 or have violated these Terms.
Registration; Account Security
To access certain features, you may need to register an account and provide accurate, current, and complete information (“Registration Data”). You are responsible for: (a) maintaining the confidentiality of your credentials; (b) all activities under your account; and (c) promptly updating Registration Data. Notify us immediately of any unauthorized use or other security breach. We are not liable for losses arising from your failure to comply with this section.
Hardware and Software Requirements; Mobile Access
To use the Service and access/retain documents electronically, you will need a current browser we support, an internet connection, and a PDF reader (e.g., Adobe Reader). If accessing via mobile, you may need apps that allow printing/saving PDFs. If your device lacks these capabilities, access the Service from a compatible device.

Proprietary Rights; Limited License
All content on the Service, including designs, text, graphics, logos, images, video, information, software, and their selection and arrangement (collectively, “Service Content”), is owned by or licensed to Investor First Lending and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site and to download/print a copy of portions of the Service Content solely for your personal, non-commercial use, provided you keep all proprietary notices intact.
Except for your own content as permitted by law, you may not copy, modify, distribute, frame, reproduce, republish, download, display, post, transmit, sell, or create derivative works from the Service or Service Content without our prior written permission. Data mining, scraping, or similar extraction methods are prohibited. Any unauthorized use terminates the license.
All trademarks, service marks, logos, and trade dress used on the Service are the property of Investor First Lending or their respective owners and may not be used without prior written permission.
User Representations; Acceptable Use
You represent and warrant that any materials you submit through the Service do not infringe third-party rights or violate law. You agree not to:
Use the Service in an unlawful, abusive, harassing, defamatory, obscene, or otherwise objectionable manner;
Interfere with or disrupt the Service or networks connected to the Service;
Register more than one account (unless authorized), register for others without authority, or misrepresent your identity;
Upload or distribute unsolicited advertising, spam, chain letters, pyramid schemes, or other solicitations;
Post or share others’ private information without authorization;
Upload malware, viruses, or harmful code;
Solicit information from anyone under 18;
Harvest or collect information about users without consent;
Use or attempt to use another’s account without authorization;
Engage in any activity that, in our sole judgment, restricts or inhibits any other person from using/enjoying the Service or exposes us or users to harm or liability.
We may (but have no obligation to) monitor, moderate, or remove content or access in our sole discretion.
User Content
You are solely responsible for any content you upload, publish, provide, or display on/through the Service (“User Content”). By posting User Content, you grant Investor First Lending an irrevocable, perpetual, non-exclusive, transferable, sublicensable, worldwide, royalty-free license to use, copy, host, store, reproduce, modify, create derivative works, publicly perform/display, and distribute such User Content in connection with operating, promoting, and improving the Service. You can remove your User Content at any time; however, the license will continue as necessary for backups, business records, and where your content has been used or shared.
Some authorized users (e.g., underwriters, brokers) may view personal and property data for legitimate loan evaluation; such users must maintain confidentiality and use it solely for that purpose.
We may preserve and disclose User Content if required by law or in good faith to: comply with legal process; enforce these Terms; respond to claims; or protect rights, property, or safety.

Your notice must include all elements required by 17 U.S.C. §512(c)(3). We may terminate repeat infringers in appropriate circumstances.
Third-Party Services and Links
The Service may contain links to or integrations with third-party websites, content, or services (“Third-Party Services”), including Arive (for loan applications), GoHighLevel (CRM/marketing), Google Analytics, and Facebook technologies. We do not endorse or control Third-Party Services and are not responsible for their content, policies, or practices. Your use is at your own risk and subject to third parties’ terms and privacy policies.
Consent to Electronic Transactions and Disclosures (E-Sign)
Because we operate online, you consent to receive documents, communications, notices, contracts, disclosures, and IRS forms electronically related to: (i) any loan inquiry/application; (ii) registration; (iii) loans made to you; (iv) your use of the Service; and (v) servicing. We may deliver such materials via the Service or email. You should maintain means to access, view, print, and save PDFs.
If you withdraw electronic consent, you may no longer be able to submit loan requests via the Service. For sensitive loan application data, you may be directed to Arive, which provides its own electronic consent and governs those disclosures per its policies.
Special Notice for International Use; Export Controls
Software and data transmissions related to the Service may be subject to U.S. export control laws. You agree to comply with applicable export/import and local laws regarding your use of the Service.
Cellular Phone Contact Policy (TCPA)
By providing us with a telephone number, including a mobile number (or converting a number to mobile), you expressly consent to receive communications from us and our affiliates/agents at that number, including calls, text messages, prerecorded/artificial voice messages, and calls made with an automatic telephone dialing system, about products or services offered by Investor First Lending. Consent is not a condition of obtaining goods or services. Your carrier may charge fees. You may revoke consent at any time by emailing [email protected] or replying “STOP” to text messages.
Monitoring and Recording
Where permitted by law, we may monitor and/or record phone calls, texts, chats, and other communications for quality assurance, training, compliance, and security.
Promotions; Referral/Affiliate Program
From time to time, we may offer promotions, incentives, credits, or fee discounts (collectively, “Promotions”). We may set/change qualification requirements, terms, and amounts in our sole discretion, and may withhold/deduct benefits obtained in error or violation of applicable terms.
We may offer a referral or affiliate program (“Referral Program”). Participation is subject to these Terms and any posted program rules. Referral Program participants must comply with all applicable laws (including advertising, privacy, and TCPA) and our Privacy Policy. Only one participant may receive credit for a given referral, as determined by us in our sole discretion.
Commercial Use
Except as expressly authorized by us, you agree not to display, distribute, license, perform, publish, reproduce, duplicate, copy, create derivative works from, modify, sell, resell, exploit, or transfer any portion of the Service or Service Content for commercial purposes.
User Disputes
You are solely responsible for your interactions with other users. We may (but have no obligation to) monitor or become involved in disputes.
Disclaimers
YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not control or guarantee user content or Third-Party Services and are not responsible for offensive, unlawful, or otherwise objectionable content you may encounter. We do not guarantee that you will obtain financing or any particular outcome.
The Service may be temporarily unavailable for maintenance or other reasons. We assume no responsibility for errors, interruptions, delays, or unauthorized access, or for technical malfunctions of networks, systems, software, or equipment.
We may change any Service content at any time without notice. Reference to any third-party product/service does not constitute endorsement.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, INVESTOR FIRST LENDING AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS OR LOST DATA, ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY FOR ANY CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO INVESTOR FIRST LENDING FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR (B) $1,000.
Certain laws may not allow limitations on implied warranties or exclusion/limitation of certain damages. If those laws apply to you, some disclaimers/limitations may not apply, and you may have additional rights.
Governing Law; Venue
These Terms and your use of the Service are governed by the laws of the State of Arizona, without regard to conflict-of-laws principles. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Maricopa County, Arizona, for any court proceeding permitted under these Terms.
Arbitration; Waiver of Jury Trial and Class Action
At either party’s election, any dispute, claim, or controversy arising out of or relating to these Terms or the Service (collectively, “Claims”) shall be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) under its applicable rules. Venue shall be Phoenix, Arizona, before a single arbitrator. The arbitrator may award individual relief but may not conduct class or representative proceedings or award punitive or other excluded damages.
YOU AND INVESTOR FIRST LENDING WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION. This arbitration provision evidences a transaction in interstate commerce and is governed by the Federal Arbitration Act. Notwithstanding the foregoing, either party may seek temporary/preliminary injunctive relief in court to avoid immediate and irreparable harm.
If we change this arbitration section after you first accepted these Terms, you may reject the change by written notice within 30 days of the change’s effective date; in that case, arbitration will proceed under the prior version.
Indemnity
You agree to indemnify, defend, and hold harmless Investor First Lending, its affiliates, and their directors, officers, employees, agents, and contractors from and against any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (i) your User Content; (ii) your use of the Service; (iii) your violation of these Terms or applicable law; or (iv) your violation of any third-party right.
Submissions
Any ideas, suggestions, or feedback you submit (“Submissions”) are non-confidential and become our sole property. We may use and disclose Submissions without restriction or compensation.
Other Terms
These Terms constitute the entire agreement between you and Investor First Lending regarding the Service and supersede prior agreements. You may not assign these Terms without our prior written consent; we may assign or transfer these Terms without restriction. If any provision is held invalid, the remaining provisions remain in full force. Our failure to enforce any right is not a waiver. Section headings are for convenience only. Notices may be provided by email, posting on the Service, or other reasonable method. A printed version of these Terms and of any electronic notice is admissible to the same extent as other business documents.
Patriot Act Notice
To help the government fight the funding of terrorism and money laundering activities, federal law requires us to obtain, verify, and record information that identifies each person who creates a relationship with us. When you engage with us, we may ask for your name, address, date of birth, and other identifying information.
